This Privacy Policy describes how SPECTRALHELIX TECHNOLABS LLP, a limited liability partnership incorporated under the laws of India having its registered office at Building 3/58/A, Vattukulangara House, Ponnore, Parappur, Thrissur — 680552, Kerala, India ("SPECTRALHELIX TECHNOLABS LLP", "we", "us", or "our"), collects, uses, stores, discloses, and protects personal data of users of the LinktoDM service ("LinktoDM" or the "Service") accessible at linktodm.com. For the purposes of the Digital Personal Data Protection Act, 2023 and the rules made thereunder (the "DPDP Act"), SPECTRALHELIX TECHNOLABS LLP is the Data Fiduciary in respect of personal data of natural persons ("Data Principals") who use the Service. By accessing or using the Service, you confirm that you have read and understood this Privacy Policy.

INFORMATION WE COLLECT

  • Your username, password and e-mail address when you register for an LinktoDM account.
  • Profile information that you provide for your user profile (e.g., first and last name, picture, phone number). This information allows us to help you or others be "found" on LinktoDM.
  • User Content (e.g., photos, comments, and other materials) that you post to the Service.
  • Communications between you and LinktoDM. For example, we may send you Service-related emails (e.g., account verification, changes/updates to features of the Service, technical and security notices). Note that you may not opt out of Service-related e-mails.

Analytics information

We use third-party analytics tools to help us measure traffic and usage trends for the Service. These tools collect information sent by your device or our Service, including the web pages you visit, add-ons, and other information that assists us in improving the Service. We collect and use this analytics information with analytics information from other Users so that it cannot reasonably be used to identify any particular individual User.

HOW WE USE YOUR INFORMATION

  • provide, improve, test, and monitor the effectiveness of our Service
  • develop and test new products and features
  • monitor metrics such as total number of visitors, traffic, and demographic patterns
  • diagnose or fix technology problems
  • automatically update the LinktoDM application on your device
  • LinktoDM or other Users may run contests, special offers or other events or activities ("Events") on the Service. If you do not want to participate in an Event, do not use the particular Metadata (i.e. hashtag or geotag) associated with that Event.

SHARING OF YOUR INFORMATION

  • LinktoDM values your privacy most so we will not rent or sell your information to third parties outside LinktoDM without your consent.
  • Any information or content that you voluntarily disclose for posting to the Service, such as User Content, becomes available to the public. Once you have shared User Content or made it public, that User Content may be re-shared by others.
  • If you remove information that you posted to the Service, copies may remain viewable in cached and archived pages of the Service.
  • We may access, preserve and share your information in response to a legal request (like a search warrant, court order or subpoena) if we have a good faith belief that the law requires us to do so. This may include responding to legal requests from jurisdictions outside of the India where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards. We may also access, preserve and share information when we have a good faith belief it is necessary to: detect, prevent and address fraud and other illegal activity; to protect ourselves, you and others, including as part of investigations; and to prevent death or imminent bodily harm. Information we receive about you may be accessed, processed and retained for an extended period of time when it is the subject of a legal request or obligation, governmental investigation, or investigations concerning possible violations of our terms or policies, or otherwise to prevent harm.

DATA SECURITY

We implement reasonable security safeguards as required under Section 8(5) of the DPDP Act to protect personal data against unauthorised access, alteration, disclosure, loss, or destruction. These include:

  • Encryption of personal data in transit using Transport Layer Security (TLS / HTTPS) on all endpoints of the Service.
  • Account credentials are stored using one-way cryptographic protections so that the underlying password is not retrievable in plain form by our personnel.
  • Role-based access controls limiting personnel access to personal data on a least-privilege, need-to-know basis.
  • Authentication safeguards on administrative interfaces to the Service.
  • Periodic review of our security practices in light of evolving threats and standards.

No method of transmission over the internet or electronic storage is fully secure. While we use commercially reasonable means to protect personal data, we cannot guarantee absolute security against all threats.

DATA RETENTION AND DELETION

  • We retain personal data only for as long as necessary to provide the Service, fulfil the purposes for which it was collected, or comply with applicable law.
  • You may request deletion of your account and associated personal data at any time by emailing support@linktodm.com or through your account settings. Upon receipt of a valid deletion request, we delete your personal data from our active systems.
  • We do not maintain offline backups of personal data. Consequently, deletion is final and cannot be reversed.
  • Where we are required by applicable law (for example, taxation, accounting, or compliance with legal process) to retain certain records beyond your deletion request, we will retain only the minimum data required for that purpose and will not use it for any other purpose.

YOUR RIGHTS AS A DATA PRINCIPAL

Under the DPDP Act, you have the following rights in respect of your personal data:

  • Right to information — to obtain confirmation of whether we are processing your personal data, and a summary of the personal data being processed and the processing activities undertaken.
  • Right to correction and erasure — to request correction of inaccurate or misleading personal data, completion of incomplete personal data, updating of personal data, and erasure of personal data that is no longer necessary for the purpose for which it was collected.
  • Right to grievance redressal — a readily available means of registering grievances regarding any act or omission by us in respect of your personal data; see the Grievance Officer section below.
  • Right of nomination — to nominate, in the manner prescribed under the DPDP Act, another individual to exercise these rights in the event of your death or incapacity.
  • Right to withdraw consent — where processing is based on your consent, to withdraw such consent at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.

We will endeavour to acknowledge grievances within seven (7) working days of receipt and to resolve them within thirty (30) days, or such shorter period as may be prescribed under applicable law. If you are not satisfied with our response, you may approach the Data Protection Board of India in accordance with the DPDP Act.

PERSONAL DATA BREACH NOTIFICATION

In the event of a personal data breach affecting your personal data, we will notify the Data Protection Board of India and, where required, affected Data Principals in accordance with Section 8(6) of the DPDP Act and the rules made thereunder, in the form, manner, and within the timeframe prescribed.

CROSS-BORDER DATA TRANSFERS

We may process and store personal data in jurisdictions outside India where our service providers (including cloud hosting and analytics providers) operate. We will not transfer personal data to any country or territory that the Central Government of India notifies as a country to which transfers are restricted under the DPDP Act. Where personal data is transferred outside India, we put in place appropriate contractual and technical safeguards.

GOVERNING LAW AND JURISDICTION

This Privacy Policy and any matters arising from or related to it shall be governed by and construed in accordance with the laws of India. Subject to the dispute resolution provisions of our Terms of Service, the courts at Thrissur, Kerala, India shall have exclusive jurisdiction in respect of any matters arising out of or in connection with this Privacy Policy.

CHANGES TO OUR PRIVACY POLICY

SPECTRALHELIX TECHNOLABS LLP may modify or update this Privacy Policy from time to time, so please review it periodically. We may provide you additional forms of notice of modifications or updates as appropriate under the circumstances. Your continued use of LinktoDM or the Service after any modification to this Privacy Policy will constitute your acceptance of such modification.
